1. Acceptance of Terms
By accessing or using PainSignal ("the Platform"), you agree to be bound by these Terms of Service. PainSignal is operated as part of the GZOO Business Platforms portfolio. If you do not agree to these terms, do not use the Platform.
2. Description of Service
PainSignal is a free market intelligence platform that collects and analyzes publicly available data to surface real-world problems and business opportunities. The Platform provides AI-classified problem signals, opportunity clusters, app concept briefs, and community features including voting, comments, and project submissions.
PainSignal is provided free of charge. There are no paid tiers, gated features, or usage limits beyond the rate limits described below.
3. Account Registration
- You must provide accurate information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You must be at least 16 years old to create an account.
- One account per person. Creating multiple accounts to bypass rate limits or bans is prohibited.
4. User-Generated Content
You may submit content to the Platform, including comments, project submissions ("I'm Solving This" claims), and votes. By submitting content, you:
- Retain ownership of your content. You grant PainSignal a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce your content on the Platform and in promotional materials (e.g., newsletters, social media).
- Represent that your content is accurate, does not infringe on any third party's rights, and complies with these Terms.
- Acknowledge that your content may be publicly visible and associated with your username and profile.
5. Project Submissions
When submitting a project via "I'm Solving This," you agree that:
- The project must be a real product, tool, or service — not a placeholder or promotional spam.
- URLs you provide must point to genuine, related pages (project site, GitHub repo, demo).
- All submissions are automatically screened for quality, relevance, and spam. Submissions that do not pass screening may be rejected or flagged for manual review.
- Monthly submission limits apply (default: 3 per month). These limits exist to maintain quality.
- We reserve the right to remove any submission that violates these Terms or degrades the quality of the Platform.
6. Acceptable Use
You agree not to:
- Submit spam, misleading, or promotional content unrelated to solving real problems
- Harass, abuse, or threaten other users
- Impersonate another person or misrepresent your affiliation
- Attempt to manipulate voting, rankings, or search results
- Use bots, scrapers, or automated tools to access the Platform beyond normal browsing
- Circumvent rate limits, bans, or content moderation systems
- Upload malicious code, viruses, or harmful content
- Use the Platform for any illegal purpose
7. Content Moderation
We use automated systems (including AI-based spam detection and link verification) and manual review to moderate content. We reserve the right to:
- Remove or hide any content that violates these Terms
- Flag content for review before it becomes publicly visible
- Suspend or ban accounts that repeatedly violate these Terms
Moderation decisions are at our sole discretion. We are not obligated to provide advance notice or detailed explanations for moderation actions, though we aim to be fair and transparent.
8. AI-Generated Content
Significant portions of the Platform's content — including problem classifications, opportunity summaries, app concept briefs, industry categorizations, and trend analyses — are generated by artificial intelligence. This content:
- Is provided for informational purposes only and should not be treated as professional advice
- May contain inaccuracies, misclassifications, or outdated information
- Does not constitute a recommendation to build any specific product or enter any market
- Should be independently verified before making business or investment decisions
9. Intellectual Property
The Platform's design, code, branding, and AI-generated content are owned by GZOO Business Platforms and protected by applicable intellectual property laws.
The underlying public data (forum posts, reviews, comments) used to generate signals belongs to their respective authors and platforms. PainSignal's AI-generated classifications and summaries are transformative works derived from that public data.
10. Rate Limits
To maintain service quality, we enforce rate limits on API requests, form submissions, and community actions. Current limits include:
- Project submissions: 3 per month (default, may be adjusted)
- Comments and votes: reasonable use limits to prevent abuse
Exceeding rate limits will result in temporary restrictions. Persistent abuse may result in account suspension.
11. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that the AI-generated content will be accurate, complete, or reliable.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAINSIGNAL AND GZOO BUSINESS PLATFORMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE PLATFORM.
Since the Platform is free, our total liability for any claim arising from these Terms or your use of the Platform shall not exceed $50 USD.
13. Account Termination
You may delete your account at any time through your account settings or by contacting us.
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. Upon termination, your right to use the Platform ceases immediately. Content you submitted may remain on the Platform in anonymized form.
14. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated to registered users via email. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
